Terms of Service

1. Agreement to These Terms

These Terms of Service (the "Terms") form a binding agreement between you and Yentar Labs LLC, a Florida limited liability company (document number L26000396630) ("MailFlat", "we", "us") and govern your access to and use of the MailFlat website, dashboard, APIs, MCP servers, SDKs and related tools (together, the "Service").

You accept these Terms by creating an account or by using the Service. The sign-up screen tells you so before your account is created, and we record which version of these Terms was in effect at that moment. If you do not agree, do not use the Service.

Two further documents are part of this agreement and are incorporated here by reference: our Acceptable Use Policy and our Privacy Policy.

If you accept these Terms on behalf of a company or other organisation, you confirm that you have authority to bind that organisation, and "you" means that organisation.

2. Definitions

  • Account: the account you create to access the Service.
  • Inbox: an email address you create on a MailFlat domain, a subdomain, or a custom domain you connect. Inboxes are permanent until you delete them.
  • Message: an email received by, or sent from, one of your inboxes.
  • Retention window: the period after which received messages are permanently and automatically deleted. The window available to you depends on your plan and is shown in your dashboard.
  • Plan: the free or paid subscription tier applied to your account, including its monthly message quota and limits.
  • Agent access: programmatic use of the Service through API keys, the SDKs, or the MCP server.
  • Your Content: messages, addresses, domain names and other data you send to, receive through, or store on the Service.

3. Eligibility & Accounts

  • Minimum age: you must be at least 16 years old to use the Service. The Service is not directed at children, and we do not knowingly collect personal data from anyone under 16. If we learn that an account belongs to someone younger, we will close it.
  • Accurate details: you must register with an email address you control and keep your account details current.
  • Account security: you are responsible for your password, your two-factor codes, and every API key issued to your account, and for all activity that takes place under it. Keep API keys out of public repositories and client-side code. Tell us promptly at support@mailflat.net if you believe your account has been compromised.
  • One account per person or organisation: creating multiple accounts to work around plan limits, quotas or free-tier allowances is a breach of these Terms.

4. The Service

MailFlat provides email inboxes for software testing, automation, one-time-passcode workflows and everyday correspondence you want to keep separate from your main mailbox.

  • Addresses are permanent. An address you create stays yours until you delete it or your account is closed. MailFlat is not a throwaway or self-expiring address service: what expires is the messages inside your inboxes, not the inbox itself.
  • Sending and receiving. Depending on your plan you can receive messages, reply to them and send outbound messages from your addresses. Outbound sending is subject to section 6 and to your plan quota.
  • Programmatic access. API keys, SDKs and the MCP server let automated systems create inboxes and read messages. You remain responsible for anything your automation does.
  • Availability. We work to keep the Service available and will give reasonable notice of planned maintenance where we can, but the Service is provided without an uptime guarantee unless a separate written agreement with us says otherwise.

5. Message Retention & Deletion

  • Automatic deletion. Received messages are permanently deleted once the retention window that applies to your inbox expires. The windows available to you, and the one currently in effect, are shown in your dashboard and on our pricing page. Deletion is irreversible: we hold no archive, no backup copy you can ask us to restore, and no way to recover a purged message.
  • Back-ups are your responsibility. If a message matters to you beyond its retention window, export or forward it before the window closes.
  • Manual deletion. You can delete individual messages, an inbox, or your entire account at any time from the dashboard. Deleting your account removes your credentials, inboxes, custom domain configuration and stored messages.
  • Operational records. A small amount of technical data, such as request logs kept briefly for security and rate limiting, is retained as described in the Privacy Policy.

6. Acceptable Use

Your use of the Service is governed by our Acceptable Use Policy, which forms part of these Terms. In summary, you may not use MailFlat for phishing, impersonation, fraud, unsolicited bulk email, distribution of malware, harassment, or any activity that is unlawful where you or your recipients are located, and you may not attempt to overload, probe or circumvent the limits of our infrastructure.

You are responsible for the content you receive and send through the Service and for holding any rights or permissions that content requires. Report abuse to abuse@mailflat.net.

7. Custom Domains (BYOD)

  • Ownership. By connecting a domain you confirm that you own it or are authorised to configure it. Connecting domains that imitate another company, use someone else's trademark, or exist to deceive recipients is prohibited and will lead to removal of the domain and possible account termination.
  • DNS is yours to configure. You are responsible for the MX, SPF, DKIM and any other records required. We provide the values and a verification check; we cannot control your registrar or DNS provider.
  • Deliverability. We are not responsible for mail that is delayed, rejected, filtered as spam or lost as a result of DNS configuration, registrar changes, domain expiry, or decisions made by receiving mail providers.
  • Reputation. Sending practices on your domain affect its reputation. Persistent spam complaints on a connected domain may lead us to disable outbound sending for that domain.

8. Encryption & Key Loss

MailFlat offers optional end-to-end encryption at rest. When you enable it, your browser generates a key pair, the private key stays in your browser, and incoming messages are encrypted with your public key before they are written to disk.

This design means we cannot read your encrypted messages. It also means we cannot recover them. If you lose your private key, clear your browser storage without a backup, or lose the credentials protecting your key escrow, the affected messages are unrecoverable by you and by us. You accept that risk when you enable the feature.

9. Plans, Billing & Payment

  • Free and paid plans. The current plans, prices, quotas and limits are shown on our pricing page and in your dashboard. Those pages are the authoritative source; nothing in these Terms fixes a particular price or quota.
  • Payment processor. Payments are processed by Stripe. We do not receive or store your full card details. Your use of Stripe is subject to Stripe's own terms.
  • Automatic renewal. Paid subscriptions renew automatically for successive billing periods at the then-current price until cancelled. You authorise us, through Stripe, to charge your payment method for each renewal.
  • Quota behaviour. If you exceed your monthly message quota we pause incoming delivery for the rest of the billing period or until you upgrade. We do not charge automatic overage fees.
  • Failed payments. If a payment fails, we may retry it, restrict paid features, or move the account to the free plan. Free-plan limits then apply to retention and inbox counts.
  • Taxes. Prices are exclusive of taxes unless stated otherwise. You are responsible for any sales, use, VAT or similar taxes, other than taxes on our income.
  • Price changes. We may change prices. Changes take effect at your next billing period, and we will give you reasonable advance notice by email or in the dashboard.

10. Refunds, Cancellation & Downgrades

  • Cancellation. You can cancel at any time from the billing portal. Your paid plan continues until the end of the billing period you have already paid for, then reverts to the free plan. Free-plan limits, including its shorter retention window, apply from that point, so export anything you need first.
  • Downgrades. A downgrade to a lower tier applies immediately. Proration credits are disabled for downgrades, so no refund or credit is issued for the remainder of the current period, and the new rate applies from the next billing period.
  • Refunds. If you upgrade and change your mind, contact support@mailflat.net within 14 days of that upgrade and we will consider a refund. Beyond that window, payments are non-refundable except where required by law.
  • No refund for termination for cause. If we terminate your account for a breach of these Terms or the Acceptable Use Policy, fees already paid are not refunded.

11. Fair Use & Service Limits

The Service applies technical limits such as request rate limits, message quotas, inbox counts and per-message size limits. These protect availability for everyone. You may not attempt to circumvent them, for example by rotating accounts, distributing traffic across IP addresses to evade rate limiting, or scripting sign-ups.

Where usage is extreme enough to degrade the Service for others, we may throttle it, contact you to move to a suitable plan, or suspend the account under section 12.

12. Suspension & Termination

  • By you. You may stop using the Service and delete your account at any time from the dashboard. Deletion is immediate and permanent.
  • By us, for cause. We may suspend or terminate your account, remove content, or disable a connected domain if you breach these Terms or the Acceptable Use Policy, if your account is used unlawfully, if payment fails and is not resolved, or if we are required to do so by law. Where the breach is serious, for example phishing or malware distribution, we act without prior notice.
  • By us, for convenience. We may discontinue the Service or close free-plan accounts with at least 30 days' notice by email. If we discontinue a paid plan you are on, we will refund the unused portion of the period you have paid for.
  • Effect of termination. Access ends and your data is deleted in line with section 5. Because our deletion is immediate and permanent, retrieve anything you need before you close an account or before a suspension becomes a termination. Sections that by their nature should survive, including 14, 17, 18 and 20, survive termination.

13. Data Protection & Privacy

Our handling of personal data is described in the Privacy Policy. The third parties that process data on our behalf are listed on the Subprocessors page, which we keep current.

For personal data contained in messages you receive or send, you act as the controller and we act as your processor: we process that content to operate the Service, following your instructions as expressed through your use of it. If your organisation requires a separate data processing agreement, contact privacy@mailflat.net.

You are responsible for having a lawful basis for the personal data you route through MailFlat, and for not using the Service to collect data you are not entitled to collect.

14. Intellectual Property & Your Content

  • Ours. The Service, including its software, design, documentation and the MailFlat name and logo, belongs to us and our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service, and nothing more. You may not copy, resell, or repackage the Service as a competing product, nor reverse engineer it except to the extent that restriction is unenforceable by law.
  • Yours. Your Content remains yours. You grant us only the limited licence needed to host, process, transmit, display and delete it in order to operate the Service for you. We do not use the contents of your messages to train models, and we do not sell them.
  • Feedback. If you send us suggestions, we may use them freely and without obligation to you.
  • Open-source components. Our SDKs and client libraries are provided under their own licences, which apply to those components in place of this section.

15. Confidentiality

Each party may receive non-public information from the other, such as pricing offered under a custom agreement, security details, or unreleased features. Each party will protect that information with reasonable care, use it only for the purposes of this agreement, and not disclose it to third parties except to employees, contractors or advisers who need it and are bound by similar obligations, or where disclosure is required by law.

This does not apply to information that is public through no fault of the receiving party, was already known to it, or is independently developed by it.

16. Third-Party Services

The Service relies on third parties, including Stripe for payments, Google for optional sign-in, and infrastructure and monitoring providers listed on the Subprocessors page. We choose them with care and hold them to appropriate obligations, but we are not responsible for their acts or omissions, nor for outages or changes on their side.

Mail delivery also depends on parties we do not control, including your DNS provider and the mail systems that send to or receive from your addresses.

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE, THAT ANY MESSAGE WILL BE DELIVERED, RECEIVED OR SENT WITHOUT LOSS OR DELAY, OR THAT MESSAGES WILL BE RETAINED BEYOND THE APPLICABLE RETENTION WINDOW. BECAUSE THE SERVICE DELETES MESSAGES AUTOMATICALLY AND PERMANENTLY, YOU ARE SOLELY RESPONSIBLE FOR BACKING UP ANYTHING YOU NEED TO KEEP.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

18. Limitation of Liability & Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER MAILFLAT NOR ITS OWNERS, OFFICERS, EMPLOYEES OR SUPPLIERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

Indemnity. You will defend and indemnify us against claims, damages and reasonable costs arising from your use of the Service in breach of these Terms or the Acceptable Use Policy, from content you send or receive, or from a domain you connect.

19. Changes to the Service & These Terms

We continue to develop the Service and may add, change or remove features. Where a change materially reduces functionality you rely on, we will give reasonable notice.

We may also update these Terms. The date at the top of this page shows when the current version took effect, and we keep a record of the version in force when each account accepted them. For material changes we will notify you by email or in the dashboard before they take effect, and where the change requires it we will ask you to accept the new version. Continuing to use the Service after a change takes effect means you accept it. If you do not accept it, stop using the Service and close your account.

20. General, Governing Law & Contact

  • Governing law. These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections in your country of residence.
  • Entire agreement. These Terms, together with the Acceptable Use Policy and Privacy Policy, are the entire agreement between us about the Service and replace any earlier understanding, except where you have a separate signed agreement with us, which prevails to the extent of any conflict.
  • Severability. If a provision is held unenforceable, the rest remains in force and the provision is applied to the greatest extent permitted.
  • No waiver. Not enforcing a right on one occasion does not waive it.
  • Assignment. You may not assign this agreement without our written consent. We may assign it to an affiliate or in connection with a merger, acquisition or sale of assets.
  • No partnership. Nothing here creates a partnership, agency, employment or joint venture between us.
  • No third-party rights. No one other than you and us has rights under these Terms.
  • Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control, including network or provider outages, attacks on infrastructure, natural events, or acts of government.
  • Notices. We give notice by email to the address on your account or through the dashboard. You give notice to support@mailflat.net.
